1. Applicability
These Terms & conditions apply to all orders placed by you and confirmed by Steelyjam via our website, as well as all agreements and legal actions between Steelyjam and you. By clicking the “Place order” button on our website, you agree to these Terms & conditions. You can read, download, save, and print them here.
We reserve the right to change these Terms & conditions at any time. If this occurs, we will publish the revised version on the Steelyjam website. The updated version will take effect immediately, except for previously placed orders.
2. Ordering procedure
You must be 18 years or older to place a valid order via our website. Your order is placed the moment you click the “Place order” button. A payment obligation then arises in accordance with your selected payment method. The purchase agreement is officially concluded when Steelyjam confirms your order. Steelyjam reserves the right to decline any order.
Following confirmation, you will receive an email from Steelyjam containing the key details of your purchase, including an overview of the products and an itemised total price.
We aim to keep you fully informed and will send you email updates at various stages of the order fulfillment process.
3. Prices
All prices listed on the website include VAT at the applicable local rate, but exclude shipping costs. Shipping costs are calculated and added to your basket during the checkout process, ensuring you always see the final total price before confirming your order.
4. Payment and ownership
Steelyjam only accepts payment through the methods specified on our website, such as authorised credit cards or secure payment gateways. We do not offer credit facilities for any purchases.
All payment transactions may be subject to validation checks by your card provider or relevant third parties.
Full ownership of the ordered products only transfers to you after we have successfully delivered the items to your specified address and full payment has been received. If a payment is rejected after shipment for any reason, Steelyjam is entitled to claim payment (including statutory collection costs) or request the immediate return of the products. Steelyjam reserves the right to rescind the agreement in such cases, and any costs incurred from reclaiming the products will be charged to you.
Steelyjam shall not be liable for any delivery delays resulting from payment validation issues or rejections.
5. Delivery
We deliver products on working days during standard working hours, and occasionally on Saturdays depending on the destination country and the carrier. For specific details regarding delivery services, please refer to our website or the tracking portal of our carrier. You will receive an email with tracking information as soon as your shipment is handed over to the carrier.
Once your order is placed, you cannot change the delivery address via the website. If a change is urgent, please contact our customer service immediately to check if an adjustment is still possible. Steelyjam cannot guarantee that address changes can be made after processing. Any additional costs arising from an address change will be charged to you and confirmed via email.
Delivery dates depend on product availability and your delivery address. For in-stock items (such as ready-to-ship), we use our best efforts to deliver within 5 business days.
We assume that your specified delivery address is easily accessible by standard transport vehicles. If this is not the case, please contact our customer service via email immediately after completing your order.
Risk of loss or damage transfers to you as soon as our carrier delivers the order. From that moment on, you are responsible for the condition of the products.
If your shipment arrives with visible damage, you must record this on the delivery documents or driver’s terminal upon receipt, and inform our customer service immediately.
If you notice any internal damage to your products after unpacking, please contact our customer service department immediately.
6. Right of withdrawal
You have the right to revoke your agreement with Steelyjam within 30 calendar days of receiving your product. If your order was split into multiple shipments, the 30 days begin after you receive the final package. To initiate this, please contact our customer service department.
- Our customer service team will contact you to arrange a pick-up, or provide a pre-paid return label. Please await our team’s specific instructions before shipping.
- We will refund the purchase price and standard delivery costs within 14 calendar days of receiving the returned products. Additional costs resulting from your choice of an express or non-standard delivery method will not be refunded. Refunds are processed using the original payment method, unless otherwise agreed.
- During the 30-day withdrawal period, you may examine and test the product to ascertain its nature, characteristics, and functioning, but you are expected to handle it with due care. You will be held liable for any diminished value resulting from handling that goes beyond what is necessary. If we have reason to believe the instrument was used beyond basic testing, a quality control inspection will be conducted at your expense, and the related costs or diminished value will be deducted from your refund.
- Products must be returned complete, undamaged, and in their original or equivalent packaging. If you have questions about packaging, please contact customer service for guidance.
- If our quality control reveals damage (other than proven transport damage) or signs of use that make the product commercially unmarketable, we reserve the right to hold you liable for the diminished value, which will be confirmed via email.
- If repairs or component replacements are required to restore the product to a marketable condition, all associated costs will be deducted from your refund. We will notify you and confirm these costs by email.
7. Damaged or defective products
If we determine that a product has a defect covered by our warranty, we will:
- Replace it with an equivalent product, where possible.
- Offer a comparable alternative product if an exact replacement is unavailable.
- Arrange for a professional repair in consultation with you.
If you receive an item different from the one you ordered, please notify our customer service. We will arrange to collect the incorrect product and deliver the correct one, or issue a full refund including all shipping costs.
8. Refunds
All refunds are issued in accordance with these Terms & conditions and will be credited to the original payment method used for the order. Please note that banking institutions can take up to 5 business days to process repayments, which is completely beyond the control of Steelyjam.
9. Liability
Nothing in these Terms & conditions excludes or limits our liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any statutory rights or liabilities that cannot be excluded under applicable law.
To the fullest extent permitted by law:
- Our website and products are provided on an “as is” basis. Online product images are for illustrative purposes but aim to provide an accurate representation of the instrument.
- Our total liability for any damages, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, affecting you or a third party, shall be strictly limited to the amount you paid for the product, or the maximum amount paid out by our liability insurance provider for the specific claim.
Steelyjam, our directors, employees, and logistics partners are not liable for:
- Any indirect, incidental, or consequential damages.
- Loss of income, loss of profit, loss of goodwill, data loss, loss of contracts, or business interruption.
- Damages resulting from abnormal use, unauthorised modifications, failure to follow instructions, or negligent handling of the products.
In cases of force majeure, we are not required to fulfill our obligations or may cancel orders without liability for compensation. If a force majeure event continues for more than three months, both Steelyjam and you reserve the right to cancel the order or rescind the agreement without liability.
Force majeure includes any circumstance beyond our reasonable control that hinders the fulfillment of our obligations, including industrial action, fire, operational breakdowns, power failures, delayed deliveries from suppliers, lack of official permits, employee illness, telecommunication network failures, or website unavailability.
10. Invalidity and waiver
If any provision of these Terms & conditions is found to be invalid, void, or unenforceable by a court, the remaining provisions will continue in full force and effect. In such cases, Steelyjam and you will agree on a valid alternative provision that best reflects the intent of the original text.
Any failure or delay by Steelyjam to enforce a right or provision within these Terms & conditions does not constitute a waiver of that right.
11. Rights of third parties
These Terms & conditions do not confer any rights upon third parties.
12. Transfer of rights
We reserve the right to transfer, assign, or subcontract any of our rights and obligations under these Terms & conditions to a third party. We will notify you of any such transfer via email.
13. Governing law and disputes
These Terms & conditions, all purchase agreements, and all legal relationships between you and Steelyjam are governed exclusively by Belgian law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
Any disputes arising from or in connection with these agreements, or their interpretation, fall under the exclusive jurisdiction of the competent courts in Liège, Belgium. If Steelyjam invokes this clause, we will grant you a period of at least one month to opt for dispute resolution before the court that would otherwise have jurisdiction under standard law.
14. Complete agreement
These Terms & conditions, along with our order confirmation, constitute the entire purchase agreement between you and Steelyjam regarding your order. They replace all prior agreements, discussions, or understandings regarding the use of our website or your purchase.
